Of all amendments to the U.S. Constitution, the Fourth has been called the most ambiguous, and it is from that amendment that search and seizure laws are primarily drawn. Students will learn about the legal issues and cases argued concerning protection of property and privacy, searching homes and businesses, searching people in public places, searching automobiles and baggage, and wiretapping. The Exclusionary Rule and the right to privacy beyond search and seizure are specifically examined in detail.
Author Biography
DARIEN A. MCWHIRTER is an attorney specializing in employment and constitutional law. He received a Ph.D. in political science from Yale University, New Haven, Connecticut and a J.D. from the University of Texas Law School, Austin. He was a staff attorney with the Texas Association of School Boards and general counsel at the National Center for Employee Ownership. Dr. McWhirter is the author of Your Rights at Work and Sharing Ownership, and the coauthor of Privacy in the Workplace and Privacy as a Constitutional Right as well as the Exploring the Constitution Series, published by Oryx Press. He is a member of the California and Texas Bar Associations.
